The petitioner apprehends his arrest in connection with Sessions Trial No.284 of 2019, arising out of Excise Case No.67 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, pending in the court of the Special Excise Judge, Gaya.
The accusation is that in course of checking of the vehicles by the Excise Officials, one Hyndai Verna vehicle bearing Registration No.JH 10Q-2778 was stopped, which was being driven by Sintu Kumar Gupta, and on search, 156 bottles, each containing 750 ml. Indian Made Foreign Liquor, kept in 13
Patna High Court CR. MISC. No.59581 of 2019(2) dt.20-09-2019 2/2 cartoons, were recovered.
Learned counsel appearing on behalf of the petitioner submits that, admittedly, the petitioner is the owner of the seized vehicle but the said vehicle was sold by the petitioner to one Bikash Kumar, son of Kishore Ram, resident of Handadih Pachamba, Giridih.
Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
