JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A/34 of the Indian Penal Code. Basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and ready to keep her as wife with dignity and honour. A statement to that effect has been made in paragraph 16 of the petition which reads as follows :- "16. That the petitioner would be graciously to have his wife and child with him at his home and undertakes to keep her with all sincerity."

Patna High Court Cr.Misc. No.14350 of 2015 (5) dt.08-03-2016 2/2 Subsequently, a supplementary affidavit has been filed to the effect that the petitioner and the informant are residing together at Mexico and they have got the child admitted in a school.

The said contention of learned counsel for the petitioner has not been controverted by Mr. Rajesh Kumar Mishra, learned counsel representing the informant.

Considering the present stand of the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Katihar in connection with Mahila P.S. Case No.22/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
