2. Petitioner seeks regular bail in connection with Sessions Trial No. 53 of 2024 arising out of Sathi P.S. Case No. 93 of 2021 dated 23.05.2021 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 447, 427, 307, 302 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

The main submissions advanced by the petitioner's counsel are that this is the third attempt of the petitioner to get the relief of bail and while rejecting the earlier prayer of the petitioner, this Court gave liberty to the petitioner to renew his prayer either after the examination of non-official prosecution witnesses or after one year from the date of that order and now,

No.67003 of 2025(2) dt.19-09-2025 2/3 both the conditions are favorably available, as after the last rejection order, one year has elapsed and all the non-official witnesses of the prosecution have been examined. It is further submitted that the most important witness, who is the informant, has been examined as PW-5, whose deposition copy has been filed with this petition, in which the informant made general and omnibus allegations against this petitioner, and in the crossexamination, he stated that he arrived at the place after the commission of the alleged occurrence. It is further submitted that the petitioner has been languishing in jail since 18.08.2021 and as official witnesses are yet to be examined in the trial of the petitioner, there may be some delay in the conclusion of the petitioner's trial.
4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner and submits that there is serious allegations against this petitioner.
5. Heard both the sides and perused the relevant materials. Though there is serious allegation against this petitioner, however, considering his present custody period which has been about four years and also taking into account the examination of the material witnesses of the prosecution as stated above, this Court is now inclined to give the relief of bail
Patna High Court CR. MISC. No.67003 of 2025(2) dt.19-09-2025 3/3 to the petitioner. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Sessions Trial No. 53 of 2024 arising out of Sathi P.S. Case No. 93 of 2021.
