JUSTICE RAKESH KUMAR ORAL ORDER 13-07-2016 Heard Sri Sanjay Kumar No. 7 , learned counsel for the petitioner , Sri Iftekhar Mahmood, learned Additional Public Prosecutor as well as Sri Manoj Kumar, learned counsel who has voluntarily appeared on behalf of the informant. The petitioner, who is in custody since 28.3.2016 in connection with Chanpatia P.S. Case No. 240 of 2015 registered for the offence under section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that though there is allegation against the petitioner that he fired which hit the leg and back of the informant the doctor during examination has found the injuries as simple in nature. He further
Patna High Court Cr.Misc. No.26891 of 2016 (2) dt.13-07-2016 2/2 submits that petitioner is next door neighbour of the informant and due to land dispute false case has been instituted and prior to lodging of this case earlier the mother of the petitioner had also lodged a case against the informant's side. Learned counsel for the informant while opposing the prayer for bail submits that besides this case the petitioner is accused in one another case also.
In view of the facts and circumstances particularly the fact that there was land dispute in between the parties , let the petitioner Binod Sah be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatia P.S. Case No. 240 of 2015.
