2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 420, 413, 414, 467, 468 and 471 of the Indian Penal Code.
3. As per allegation in the FIR, petitioner is involved in sell and purchase of stolen motorcycle and from his house one stolen motorcycle was recovered.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is engaged as a mechanic in garage of co-accused Vinod Sah and the recovered motorcycle was of his garage. Main accused is Vinod Sah and he ahs already been enlarged on bail by
Patna High Court CR. MISC. No.69266 of 2023(3) dt.02-11-2023 2/2 another coordinate Bench of this Court vide order dated 16.10.2023 passed in Cr. Misc. 66178 of 2023. Petitioner has got no criminal antecedent and languishing in judicial custody since 29.6.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bettiah Town PS Case No. 508 of 2023.
