Petitioner being husband of the informant is languishing in custody since 20.05.2016 in a case registered for the offences punishable under Sections 341, 323, 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of dowry demand.
It is submitted by the learned counsel for the petitioner that the petitioner has been implicated with false accusation. The petitioner has filed Matrimonial Suit No. 59 of 2015 on 04.05.2015 with the prayer for divorce and also filed a Complaint Case No. 735(C)/2015 against the informant side.
Patna High Court Cr.Misc. No.27076 of 2016 (2) dt.30-06-2016 2/2 Considering the nature of accusation, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachia in connection with Naugachia P. S. Case No. 107 of 2015.
