Petitioner seeks bail in a case registered under sections 302, 376, 201/34 of the Indian Penal Code and sections 6, 8, 10 of the POCSO Act.
Petitioner is not named in the first information report and his name surfaced in this case in the confessional statement of coaccused Jittu Sao who disclosed the manner in which deceased was raped and killed.
It would appear from perusal of the case diary that the name of Jittu Sao came in this case on the basis of call detail of mobile phone of the aforesaid Jittu Sao as well as deceased. Investigation against the petitioner has already been completed and except confessional statement of co- accused Jittu Sao as well as confessional statement of the petitioner, there appears to be nothing against him.
Patna High Court Cr.Misc. No.29768 of 2016 (4) dt.08-11-2016 Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge I, Patna in Special (POCSO) case no. 42/2016 arising out of Rani Talab P.S. Case no. 32/2016.
