====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 23-11-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offence punishable under Sections 272, 273, 120B of the Indian Penal Code and Sections 30 (a), 38 (1) and 47 of Bihar Excise Amendment Act, 2016.

It is contended that, as per allegation, 900 liters of foreign liquor was recovered from a Truck. The petitioner nos. 1 and 2 claim to be the Driver and Owner respectively of the said truck. It is stated that they do not have any connection with the recovered illicit liquor. It is urged that the petitioners are in custody since 15.08.2017,i.e, for more than three months. It is claimed that their antecedents are clean.

No.56029 of 2017(2) dt.23-11-2017 2/2 Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Gaya in connection with Barachatti P.S. Case No. 490/2017 with a condition that if the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.

However, one of the bailors must be belonging to the State of Bihar.
