JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This modification application has been filed for modification of order dated 26.06.2019 passed in Cr. Misc. No. 24615 of 2019, by which, the petitioner has been granted the privilege of anticipatory bail and was directed to surrender in the court below within a period of six weeks. Submission of learned counsel for the petitioner is that due to inadvertence, the petitioner could not surrender in the court below within the time fixed by this court and thus prayed for modification of order dated 26.06.2019 and for extension of time to surrender in the court below. Heard learned APP also.

Having heard both sides, considering the facts and circumstances and also the fact that the order was passed on

Patna High Court CR. MISC. No.81789 of 2019(2) dt.22-01-2020 2/2 26.06.2019, whereas, the present modification application has been field on 03.09.2019, as such, I am not inclined to modify the 26.06.2019 passed in Cr. Misc. No. 24615 of 2019. However, if petitioner surrenders in the court below and pray for regular bail, the court below after considering the fact that the petitioner was earlier granted the privilege of anticipatory bail but due to inadvertence, he could not surrender in the court below within the time fixed by this Court, shall dispose of the prayer for bail of the petitioner.

This application is accordingly disposed of.
