The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 354(B) and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner tried to outrage the modesty of informant's wife. Petitioner used to do obscene acts with the informant's daughters while they were taking bath.

It is submitted that both parties are Gotia and due to pending land dispute between them this false and concocted case has been lodged. No specific overt act has been alleged against this petitioner. Present case is counter version of a case bearing Chautarwa (Bathawariya) PS Case No. 98 of 2022

Patna High Court CR. MISC. No.65559 of 2022(2) dt.05-05-2023 2/2 which was lodged by Lalji Tiwari from the petitioner's side. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Bagaha, West Champaran in connection with Choutarwa (Bathwariya) P.S. Case No. 99 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
