Learned counsel for the petitioner submits that the petitioner filed Title Suit No.650 of 2015 for declaration of title over the land in question from Kamla Kant Dubey and Hanuman Dubey through registered sale deed dated 12.11.1956. The suit was decreed. The petitioner filed petition before the Circle Officer, Sasaram for mutating his name but the Circle Officer did not receive the petition of the petitioner for mutating his name with regard to the land in question. The Circle Officer being the competent authority is duty bound and obliged under

Patna High Court CWJC No.18681 of 2019(2) dt.11-09-2019 2/2 the law to receive the petition of a person for mutation of any land in his name on the basis of transfer or on any other ground stated in the Mutation Act, 2011.

Having considered the facts aforesaid, I dispose of this writ petition with direction to the petitioner to present a petition in prescribed proforma before the Circle Officer for mutating his name and on such the Circle Officer, Sasaram, Rohtas after registering the case shall dispose of the case in accordance with law within four months from the date of receipt of such petition.

With the aforesaid direction, the writ petition is disposed of.
