Petitioner seeks bail in a case registered under Sections 379, 411, 414, 401, 403, 413, 467, 471, 419 and 420/34 of Indian Penal Code.

It is submitted on behalf of the petitioner that no recovery whatsoever has been made from the possession of the petitioner and that other co-accused Sonu Kumar Sah, from whose possession, bullet motorcycle has been recovered, has been granted bail by order dated 11.05.2016 passed in BP No 369 of 2016 as is evident from order dated 06.03.2017 passed in BP No 1389 of 2016. There is one case pending against the petitioner

Patna High Court Cr.Misc. No.57568 of 2017 (5) dt.28-02-2018 2/2 from before in which he has stated that he is on bail. Considering his aforesaid submissions, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in Madhubani Town Police Case No 480 of 2015 dated 11.11.2015 corresponding to GR No 2985 of 2015 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
