1. Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Informant.
2. The petitioner apprehends his arrest in connection with Complaint Case No. 152 of 2022 registered under Sections 323, 498(A) of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. Further submission is that the petitioner had earlier filed a divorce case bearing Matrimonial Case No. 90 of 2021 which is
Patna High Court CR. MISC. No.68286 of 2023(2) dt.01-11-2023 2/2 annexed at Annexure-3 to the bail petition.
4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Mohaniya at Kaimur in connection with Complaint Case No. 152 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.
