2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 366(A), 504, 506/34 of the Indian Penal Code and Section 8 of the POCSO Act.

3. As per prosecution case, it is a case of abduction of minor daughter of the informant, aged about 17 years by the FIR named accused Arun Turi.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. He is brother-in-law of the the FIR named accused Arun Kumar Turi due to which he has falsely been implicated in this case. There is no specific

Patna High Court CR. MISC. No.68761 of 2023(3) dt.09-01-2024 2/2 allegation of abduction against this petitioner. He has got no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 26.7.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the victim girl is still traceless.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Sono P.S. Case No. 197 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-Cum-Special Judge SC/ST POCSO Act, Jamui.
