The petitioner is in custody in connection with Special Case No. 06 of 2017 arising out of NCB Crime No. 20 of 2017, a case under Sections 8, 21 (C) of the N.D.P.S. Act of the Indian Penal Code.

1.900 Gm. of Heroine was recovered from possession of co-accused Md. Mustaffa. The petitioner was also along with Md. Mustaffa. However, nothing was recovered from possession of the petitioner. Md. Mustaffa had disclosed that petitioner was having knowledge about that heroine and was also involved in carrying the same along with petitioner. The petitioner had stated on oath

Patna High Court Cr.Misc. No.58064 of 2017 (4) dt.08-01-2018 2/2 that he has got no criminal antecedent.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No. 06 of 2017 arising out of NCB Crime No. 20 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
