JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-12-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner no. 2 apprehends his arrest in a case registered for the offence punishable under Sections 272, 273, 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.
135 litres of illicit liquor has been recovered from the bank of Kari Koshi river.
It is submitted that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from open place which is accessible to general public. Petitioner claims clean antecedent.
