JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 323 and 307 of the Indian Penal Code and 27 of the Arms Act.
Allegation against the petitioners is to have attacked and assaulted him and his nephew while they were returning after counting PACS election result. In the course of assault, his nephew got injured in his right hand.
It has been submitted on behalf of the petitioners that they have been made accused in the present case due to land dispute. It is a case and counter case between the parties. A Title Suit is also pending between the parties. From perusal of the injury report from the case diary, it is evident that injuries are simple in nature.
On behalf of the State, it is submitted that the petitioner is

Considering the aforesaid facts, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Smt. Richa Bhargaw, learned Judicial Magistrate, Ist Class, Sasaram, in connection with Kargahar (Sidhi) P.S. Case no. 78 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
