JUSTICE SUDHIR SINGH ORAL ORDER 18-10-2016 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 01.05.2016 in connection with Town P.S. Case No. 286 of 2016 registered for offence under Section 366A of the Indian Penal Code.

The prosecution story, in brief, is that the victim girl was kidnapped by the petitioner.

On behalf of the petitioner it has been submitted that the charge sheet has been submitted in the case. There is no criminal antecedent against the petitioner and there is no allegation of tampering of the witness alleged against the petitioner. The victim girl has been examined under Section 164 of the Criminal Procedure Code and she has not made any allegation of inducement or physical abuse.

On behalf of the State it has been submitted that the petitioner is named in the First Information Report. Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten

Patna High Court Cr.Misc. No.33411 of 2016 (3) dt.18-10-2016 thousand) with two sureties of the like amount each in connection with Town P.S. Case No. 286 of 2016 to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur.
