2. In this case, the petitioner is seeking regular bail in connection with Nokha P.S. Case No. 216 of 2024, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2022.

3. As per allegation, 622.66 liters of foreign liquor was recovered from a vehicle which was being driven by the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from his conscious possession. He is merely the driver of the alleged vehicle and he

5. Considering the above-mentioned facts and circumstances as well as one criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is hereby rejected.

6. However, if so advised, the petitioner may renew his prayer for bail before the learned court below itself after three months from today.

7. The learned court below shall consider the bail application of the petitioner on its own merit without being prejudiced by this order.
