The petitioners are languishing in custody since 20.03.2015 in connection with Khizersarai P.S. Case No. 61 of 2015 for the offences instituted under Section 302 of the I.P.C.
Patna High Court Cr.Misc. No.25202 of 2015 (3) dt.02-09-2015 2/2 The prosecution story, in brief, is that the dead body of son of the informant, namely, Balmiki Prasad was found lying in Falgu river and his head was found smashed by stones and therefore it was suspected that he was killed by some unknown persons.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 20.03.2015 and the charge sheet has been submitted in the present case. The petitioners are not named in the F.I.R. The name of the petitioners has come in course of investigation. The petitioners have got no criminal antecedent. Other accused person has been granted bail by this Court vide Cr. Misc. No. 27079 of 2015.
On behalf of the State it has been submitted that the petitioners are not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, in connection with Khizersarai P.S.
