Petitioner seeks regular bail in connection with Excise Case No.919 of 2017 arising out of Ghosi P.S.Case No.192 of 2017 instituted for the offence under Sections 420, 467, 468, 471, 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act,2016.
The allegation is regarding recovery of 1179 litres of foreign wine from the Pick-Up Van from near the house of Ashok Sharma and one co-accused, namely, Chintu Sharma was standing near the said vehicle.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case merely
Patna High Court Cr.Misc. No.59403 of 2017 (2) dt.22-12-2017 on discloser of the co-accused persons apprehended at the spot and he has nothing to do with the present occurrence. It is further submitted that, in fact, at the time of institution of the present case, the petitioner was having a clean antecedent but subsequently thereafter he has been roped in another case and he is languishing in jail custody since 12.10.2017.
Considering the nature of accusation and the period of custody already undergone, I direct the petitioner, named above, to be released on regular bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Jehanabad, in Excise Case No.919 of 2017 arising out of Ghosi P.S.Case No.192 of 2017.
