JUSTICE RAVI RANJAN ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 341, 323, 324 and 307 of the Indian Penal Code.

It is contended that the petitioner's husband is the informant and he is in habit of filing criminal cases against her. Two such cases were quashed by a coordinate Bench of this Court vide Annexure-3 series. Thereafter, third case has been lodged against her. In fact, it was the petitioner who has been subjected to cruelty. It is urged that though there is allegation of assault by a sharp cutting weapon, due to which the informant allegedly sustained incised wound, however, injury report shows only injury

Patna High Court Cr.Misc. No.37994 of 2016 (2) dt.26-09-2016 2/2 upon the palm caused by hard and blunt substance. Having regard to the facts and circumstances of the case, let the petitioner, namely, Sangita Pandey be released on bail in the event of her arrest/surrender before the court below within a period of six weeks from today in connection with Saraiya P.S. Case No.110 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, West, Muzaffarpur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
