JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Gaurichak P.S. Case No.256 of 2015 registered under Sections 341, 323, 324, 325, 307, 504, 506 and 34 of the Indian Penal Code.

The accusation is that the petitioner with his son Rajiv Kumar along with Sanjay Singh and Ravi Mahto came at the door of the informant and started to abuse due to land dispute. On the order of petitioner, Sanjay Singh gave lathi blow at the head of the informant, whereas this petitioner caused injury through butt of the gun at his right hand causing fracture injury and Ravi Kumar also causing injury through stick.

Patna High Court Cr.Misc. No.38792 of 2016 (2) dt.03-10-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that due to land dispute, occurrence took place. Moreover, the injury, as found on the person of the informant, is simple in nature, as detailed in the order dated 04.04.2016, whereby the prayer of bail of the petitioner was rejected by the Court below.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna City in connection with Gaurichak P.S. Case No. 256 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
