The petitioner seeks bail in Jogbani P.S. Case No. 03 of 2013, registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

The petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of Basant Paswan. Except the confession of Basant Paswan, the police did not collect any further evidence to show the involvement of the petitioner. The petitioner is in jail since 20.10.2014 and he has not been put on Test Identification Parade. Similarly situated co-accused Bikru Paswan @ Bikru Paswa and Basant Paswan have already been enlarged on bail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.30356 of 2015 (2) dt.12-08-2015 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Araria, in connection with Jogbani P.S. Case No. 03/2013.
