The petitioner seeks bail in a case registered for the offences punishable under sections 363, 366-A of the Indian Penal Code and section 3(i)(xi) of S.C./S.T. (Prevention of Atrocities) Act and section 8 of POSCO Act.

The petitioner is alleged to have forcibly caught the victim and got her seated on his cycle and tried to kidnap her but the victim fled away. Only attempt was made to kidnap the victim. The victim in her statement under section 164 Cr.P.C. disclosed that one muslim boy of her village made an attempt to kidnap her. Petitioner is in jail since 31.03.2015 i.e. for the last four and a half months.

Considering the facts aforesaid, let the petitioner

Patna High Court Cr.Misc. No.30287 of 2015 (2) dt.12-08-2015 above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, Begusarai in connection with Bhagwanpur P.S. Case No. 35 of 2015, corresponding to POSCO Case No. 20 of 2015.
