====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 20-11-2017 Heard Sri Raghwendra Pratap Singh, learned counsel for the petitioner and Sri Mukeshwar Dayal, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 09.08.2017 in Nasriganj(Rajpur) P.S. Case No.244/2016 registered for the offence under Sections 147,148,149,341,323, 324, 325,307, 379,504, 354 of the Indian Penal Code, has prayed for grant of bail .

Learned counsel for the petitioner submits that it is true that the allegation has been made against the petitioner that he gave iron rod blow on the head of elder brother of the husband of the informant, but fact remains that no grievous injury was found, rather during examination, injury was found simple in nature. He further submits that there was case and counter case

Patna High Court Cr.Misc. No.55522 of 2017(2) dt.20-11-2017 2/2 in between the parties and the petitioner is having clean antecedent, which fact has been mentioned in paragraph-3 of the petition.

Considering the fact that there was case and counter case in between the parties, nature of accused as well as clean antecedent, let the petitioner, namely, Dadan Paswan @ Ram be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Learned Sub Judge 1st -cum- A.C.J.M., Bikramganj, Rohtas in connection with Nasriganj( Rajpur) P.S. Case No.244/2016..
