Despite time being granted vide order passed on 09.10.2018 to convert this appeal to an application under Article 227 of the Constitution of India in view of the Full Bench opinion rendered in the case of Neelam Kumari Sinha versus Prashant Kumar reported in 2010(3)PLJR 632 yet order has not been carried out. On call today, none appears to press this appeal. We are persuaded to dispose of this appeal with liberty to the petitioner if so advised, to file a proper application in terms of the Full Bench judgment to question the order put to challenge in this appeal.
