The petitioner has filed the instant application for grant of regular bail in connection with Sasaram (T) (Darigaon) P.S. Case No. 516 of 2022 registered under Section 392 of the Indian Penal Code.

Allegation against the petitioner and other co-accused persons is that they were following the truck in which the informant who is driver of the said truck, stopped his truck and on pistol point they snatched about 50,000/- cash from him and fled away from the spot.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case due to village politics. The name of the petitioner came in the FIR on the basis of

Patna High Court CR. MISC. No.63902 of 2022(2) dt.17-02-2023 2/2 confessional statement of other co-accused, namely, Krishna Kumar who was apprehended by the police. Nothing has been recovered from the conscious possession of the petitioner rather the alleged motorcycle used in the occurrence and money has been recovered from the possession of another co-accused, namely, Sonu Sharma. It is further submitted that the petitioner has no concern with the alleged motorcycle. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. He is languishing in judicial custody since 23.06.2022. The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sasaram (T) (Darigaon) P.S. Case No. 516 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Rohtas at Sasaram.
