JUSTICE RAKESH KUMAR ORAL ORDER 04-12-2017 Heard Sri Sanjeev Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 13-08-2017 in Sherghati (Dobhi) P.S. Case No. 440 of 2017 registered for offence under Sections 414/34 of the Indian Penal Code and Section 30 (a) (d) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner was driver of a vehicle (Magic) and from the said vehicle, recovery of about 600 Kg. of Mahua flower was shown. The petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the petition.

Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Kamlesh

Patna High Court Cr.Misc. No.56649 of 2017(2) dt.04-12-2017 2/2 Yadav @ Kamlesh Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Sherghati (Dobhi) P.S. Case No. 440 of 2017.
