The petitioner seeks bail in connection with Sahebpur Kamal P.S. Case No. 17 of 2017 dated 23.01.2017 instituted for the offences under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

The deceased is the son of the brother-in-law of the informant. The informant has alleged that for the last two months, the deceased had been sleeping in the thatched house of one Ram Babu Singh. Whenever the deceased visited the informant, he used to tell him that he had land dispute with the petitioner who had threatened him of being killed. On 22.01.2017, the informant claims to have gone to the village Vishnupur Ahok along with his wife, where he learnt that on 19.01.2017, the

Patna High Court Cr.Misc. No.55890 of 2017 (3) dt.11-01-2018 2/3 petitioner and others, in presence of Ram Babu Singh, killed the deceased, cut him into pieces and threw the dead body in the Gandak river.

Hence, the present F.I.R.

Learned counsel for the petitioner has submitted that it does not appear to be probable that an occurrence of murder would take place on 19.01.2017 and the same would go unreported till about 22.01.2017 till the visit of the informant and his wife to the village. The only material before the informant for suspecting the petitioner and others is the earlier statement of the deceased that he was having land dispute with the petitioner. According to the admitted case of the informant, the deceased was done to death at the house of Ram Babu Singh and blood stains were also found in his house. Aforesaid Ram Babu Singh has been granted bail by a Bench of this Court vide order dated 06.09.2017 passed in Cr. Misc. No. 30323 of 2017. The mutilated parts of the dead body of the deceased was found to be floating in Gandak river.

From the records, there does not appear to be any material to suggest as to how the cut portions of the body of the deceased were identified to be that of the deceased.

Patna High Court Cr.Misc. No.55890 of 2017 (3) dt.11-01-2018 3/3 suspicion and that also an unfounded one.

The petitioner is in custody since 12.06.2017 and does not bear any criminal antecedent.

Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vth, Begusarai in connection with Sahebpur Kamal P.S. Case No. 17 of 2017(G.R. No. 223 of 2017).
