The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 07 of 2016 registered under Section 498-A of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is husband of the informant. He is innocent and has falsely been implicated in the present case. In the statement recorded under Section 161 of the Cr. P.C., mother of the informant stated that the informant and the petitioner has solemnized second marriage and living happily. Further he submits that the second husband of the informant has stated in his statement before the I.O. that the informant has solemnized marriage with him in Ashok Dham Temple and the said temple

Patna High Court CR. MISC. No.59569 of 2019(7) dt.14-02-2023 2/2 gave marriage receipt to the informant and her second husband namely Vikash Kumar, as is evident from Annexure-2. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Begusarai in connection with Mahila P.S.
