2. This is the second attempt of the petitioner for grant of regular bail in connection with Danapur P.S. Case No. 806 of 2024 / corresponding to Sessions Trial No. 964 of 2024 registered for the offence under Section 103/111 read with Section 3(5) of the BNS Act and under Section 27 of the Arms Act. Earlier the bail application of the petitioner was rejected vide order dated 19.04.2025 passed in Cr. Misc. No. 4161 of 2025.

3. The petitioner is in custody since 31.08.2024.

4. It has been submitted by the learned counsel for the petitioner that out of 13 charge-sheeted witnesses, 4 witnesses have already been examined and the injured victim has narrated the story but has not identified the petitioner.

5. Since the trial is progressing, in view of the Judgment of the Hon'ble Supreme Court in the case of X Vs. State of Rajasthan and Anr. reported in 2024 SCC OnLine SC 3539, this Court will not examine the evidence of the informant at this stage who may have been gained over by the defence.
