The petitioner, who is in custody, seeks bail in connection with Baghaila P.S. Case No. 27 of 2017 registered for the offence punishable under Section 414 of the Indian Penal Code and 25(1-b)a, 26, 35 of Arms Act.

The allegation as made in the FIR by the informant is that while he was on patrolling duty he received a secret information that the petitioner and other three persons are coming on looted motorcycle and receiving said information informant started checking of the vehicle and saw two persons coming on motorcycle and when they were asked to stop they jumped from the said motorcycle and fled away. The informant recognize the

Patna High Court Cr.Misc. No.57956 of 2017 (3) dt.12-01-2018 2/2 petitioner by the help of guard and thereafter two motorcycles and arms were seized and FIR was lodged against the petitioner. It has been contended on behalf of learned counsel for the petitioner that he was not arrested from the place of occurrence and he has been falsely implicated in this case by his enemies. It has further been contended on behalf of learned counsel for the petitioner that petitioner is in custody since 05.07.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., III, Sasaram (Rohtas), in connection with Baghaila P.S. Case No. 27 of 2017. (S. Kumar, J) veena/- U T
