This is an application for grant of anticipatory bail in connection with Chousa (Phulout) PS case no. 153 of 2017 registered for the offences punishable under Sections 144, 188, 353, 120(B)/34 of Indian Penal Code.
The learned counsel for the petitioner submits that the allegations leveled are general and omnibus against 12 named and 100 unknown persons. It is further submitted that nothing specific has been alleged against the petitioner and the petitioner has a clean antecedent. It is further submitted that co-accused persons who are similarly situated to the petitioner herein, have already been enlarged on anticipatory bail by this Court by an
Patna High Court Cr.Misc. No.61349 of 2017 (3) dt.08-01-2018 2/2 order dated 19.08.2017 passed in Cr.Misc. no. 37005 of 2017. Having regard to the facts and circumstances of the case as also the parity of the caser of the petitioner with that of the accused persons who have already been granted anticipatory bail, let the petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Udakishunganj in connection with Chousa (Phulout) PS case no. 153 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
