Perused the impugned order dated 18.05.2016, passed by the leaned Munsif-II, Bhagalpur in Title Suit No. 87 of 2001, whereby the learned court below has
Patna High Court C.Misc. No.1135 of 2016 (2) dt.23-11-2016 rejected the application filed by the present petitioner, who is defendant no. 14 in the Partition Suit, praying for rejection of the plaint under Order 7 Rule 11 (D) C.P.C.
It appears that earlier also same prayer was rejected by the court below, then the petitioner file application before the High Court which was also dismissed. Thereafter again same application has been filed in the court below. Thus, in my opinion, no case for interference in exercise of supervisory jurisdiction is made out. Thus, this Civil Miscellaneous application is dismissed.
