The petitioner seeks regular bail in connection with Tajpur (Halai) P.S. Case No.144 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 448, 380, 324, 307, 504, 506/34 of the Indian Penal Code. It is alleged that the F.I.R. named persons assaulted the informant and his family members. The allegation against the petitioner is omnibus. There is land dispute between the parties and a criminal case has also been lodged from the side of petitioner. There appears delay also in lodging the F.I.R. The petitioner is in custody since 28.07.2017 having clean antecedent. The learned A.P.P. for the State opposed the submission.
Patna High Court Cr.Misc. No.57362 of 2017 (2) dt.13-12-2017 Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned A.C.J.M.-I, Samastipur in connection with Tajpur (Halai) P.S. Case No.144 of 2017 corresponding to G.R. No.1298 of 2017.
