Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 323, 325, 326, 307, 427, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case is that petitioner Nos.
1, 2 and 4 made indiscriminate fire causing injuries to the informant on his wrist and thumb and when brother of the informant came to rescue then petitioner Nos. 2 and 4 assaulted with sword. It is further alleged that due to firing made by petitioner No. 5 the informant received splinter injuries. The accused persons also snatched Rs. 4800/- and
Patna High Court Cr.Misc. No.35441 of 2015 (2) dt.20-08-2015 2/2 gold ring from the informant.
It is submitted by learned counsel for the petitioners that injuries of the informant and his brother have been found to be simple in nature. There is counter version of the occurrence and petitioners' side also received injuries. For the occurrence of 19.11.2014 the First Information Report was registered on 22.11.2014.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the delayed lodging of the case and the case lodged by the petitioners' side at earlier point of time, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 131 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
