The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

There is recovery of 207 litres of country made foreign liquor from the fodder house of the petitioner. The petitioner is alleged to have fled away from the place of seizure.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. The petitioner has no concern with the seized illicit

In contra, learned APP vehemently opposed the prayer of the petitioner and submitted that petitioner is accused in three other cases apart from the present one. Considering the fact that petitioner is accused in three other cases apart from the present one and the recovery of illicit liquor is made from the fodder house which belongs to the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
