Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 120B, 467, 468, 469, 471 of Indian Penal Code and sections 30, 30(a), 38 and 41 of Bihar Prohibition and Excise Act, 2016.
As per prosecution case, 2590 litres of spirit has been recovered from truck and scooty.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is neither the driver nor owner of the alleged vehicles in question. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the Court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, cum 1st Exclusive Special Judge (Excise), Saran at Chapra, in connection with Dariyapur P.S.
