The petitioner apprehends his arrest in connection with Bithan P.S. Case no. 59 of 2015, registered under Sections 273 of the Indian Penal Code and Section 47(A)/54 of Bihar Excise Amendment Act, 2016.
The accusation is that on the basis of the secret information about engagement of the petitioner and three others named in the F.I.R. in illegal trading of liquor keeping the same in Room No.4 of SGRY, Bhawan, Bithan, Samastipur, the Police reached there and after opening the Room No.4 of SGRY, Bhawan, huge quantity of Indian made foreign liquor were recovered.
Learned counsel for the petitioner submits that allegation against the petitioner and others to occupy the Room No.4 of SGRY, Bhawan, but petitioner was not apprehended there. Further submission
Patna High Court Cr.Misc. No.44344 of 2016 (2) dt.22-10-2016 2/2 is that other co-accused, namely, (1) Vijay Mahto, (2) Vijay Mukhiya and (3) Sonu Jaiswal @ Sonu Kumar Jaiswal have already be granted Anticipatory Bail vide Criminal Miscellaneous No. 40952 of 2016, dated 26.09.2016.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in connection with Bithan P.S. Case No. 59 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
