The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the IPC.

As per allegation in the F.I.R., while the informant was returning to his home by his Bolero Vehicle, four miscreants who are on Scorpio, intercepted the informant's Vehicle and started to abuse him. It is further alleged that two persons, showing the fear of arms, two persons looted his vehicle and fled away towards Gopalganj. Then the present F.I.R. has been lodged against four unknown persons. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. He is

Patna High Court CR. MISC. No.69472 of 2022(2) dt.28-02-2023 2/2 innocent and has committed no offence. He is not named in the F.I.R. Nothing has been recovered from the conscious possession of the petitioner. He has been remanded in this case from Kuchaikot P.S. Case No. 340 of 2022. Save and accept self confessional statement, nothing is against the petitioner to show his involvement in the present case. There is general and omnibus allegation against him. Petitioner is languishing in judicial custody since 16.12.2019.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kuchaikote P.S. Case No. 309 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Gopalganj.
