2. The petitioner seeks regular bail in connection with Muzaffarpur Rail P.S. Case No. 186 of 2023 lodged under Sections 379 and 411 of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against one named accused persons who has been caught red handed for theft of bag of the informant. From the bag, one laptop, certificate and clothes has been recovered.

4. Learned counsel for the petitioner submits that petitioner is in custody since 09.06.2023 and there are 2 criminal cases pending against him.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.68578 of 2023(2) dt.19-10-2023 2/2 for bail and submits that the petitioner was caught at the place of occurrence and petitioner's antecedent is not clean.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.

7. However, liberty is hereby granted to the petitioner that he may renew his prayer for bail after framing of charge and trial court is directed to release the petitioner on bail imposing condition so that he may not evade his appearance during trial.
