JUSTICE ARUN KUMAR ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in Khajauli P.S. Case No.49 of 1986 registered under Sections 20(C) N.D.P.S. Act, 47(A) of Excise Act and 13 D.P. Act.

It is a case of long long misuse of privilege of bail for almost two and half decades. F.I.R. was lodged against this petitioner under Section 20 (C) of the N.D.P.S. Act and due to his misuse of privilege of bail, charge could be framed only on 3.8.2016 so at this stage, the prayer for bail of the petitioner is rejected .

Learned trial court is directed to expedite the trial. If the trial does not conclude within a year, the petitioner may renew his prayer for bail.
