The petitioners seek bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sectiions 30 (a) and 35 of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 40 litres of country made liquor was recovered from the motorcycle which was parked beside the road and the petitioners' name have been implicated on the basis of suspicion.
Patna High Court Cr.Misc. No.56225 of 2017(2) dt.23-11-2017 2/2 It is contended that petitioners have no connection with the concerned motorcycle or the recovered illicit liquor. It is urged that the petitioners have remained in custody after surrender on 09.10.2017, i.e., for about more than two and half months. It is claimed that the petitioners are having clean antecedent.
Considering the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on his furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Rohtas at Sasaram in connection with Nasriganj (Rajpur) P.S. Case No. 186 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
