2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 317(4), 317(5), 338, 336(3), 61(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, all the F.I.R. named accused persons, including this petitioner, are involved in the business of theft of motorcycles for the purpose of illegal sale and purchase.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. No stolen motorcycle has been recovered from conscious possession of the petitioner. Petitioner has been made accused in this case merely on the basis of confessional statement of co-accused who were

Patna High Court CR. MISC. No.70132 of 2025(2) dt.07-10-2025 2/2 apprehended on the spot. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Motihari, East Champaran in connection with Patahi P. S. Case No. 143 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
