JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-498A/304(B), 120(B)/34 of the Indian Penal Code and Sections-3/4 of Dowry Prohibition Act.
The allegation against the petitioner is that the informant's daughter was married with son of the petitioner and after sometimes of the marriage, the in-laws of the deceased started to torture her for fulfillment of illegal demand of dowry and ultimately, informant's daughter was killed for the same. It is submitted that there is no eye witness of the occurrence and the petitioner is relative of husband of the deceased.
Patna High Court Cr.Misc. No.46532 of 2016 (6) dt.08-02-2017 2/2 Learned Addl. Public Prosecutor opposed the prayer submitting that there is involvement of the petitioner also in the alleged occurrence.
Taking into consideration the above-said facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Bihta P.S. Case No. 516 of 2016 stands rejected.
However, the petitioner may renew his prayer for bail after framing of charge.
