The petitioner is apprehending arrest in a case registered for the offences punishable under sections 413 and 414 of the Indian Penal Code.
The informant being SI of Police, during patrolling, received information that notorious criminal Priyanshu Kumar Mishra (petitioner) along with his two friends Ajit Kumar Mishra and Vinay Kumar Mishra are present near Masan Mai temple and planning to sell a stolen vehicle, raid was laid when two persons namely the petitioner and co accused Ajit Kumar Mishra escaped from the scene but one person was apprehended who disclosed his name as Vinay Kumar Mishra.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.45970 of 2016 (2) dt.22-10-2016 2/2 petitioner that only on suspicion the accusation has been levelled. There is no recovery. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, it is a case for consideration of the prayer for bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Basantpur P.S. Case No. 167 of 2016 pending in the court of learned CJM, Siwan.
This application is disposed of with the aforesaid observation/direction.
