2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 363 and 365 of the Indian Penal Code.
3. As per prosecution case, the husband of the informant Ramashish Ram was working in the mill of petitioner, who failed to return home for over a week. When the informant inquired at the mill, this petitioner claimed that he had gone elsewhere. The informant waited for 18 months but her husband did not return nor attended her daughter's marriage 09.07.2024 and thereafter the informant suspected and lodged the present FIR against this petitioner.

It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner is innocent and has committed no offence and has been made accused in this case because he happens to be the owner of the Shaw-mill in which several employees have been working since 30 years, and the husband of the informant was also working. The husband of the informant was working in the mill of petitioner till January, 2023 but thereafter he had gone somewhere and this petitioner has no knowledge regarding it. It is further submitted that the informant's husband went missing on January, 2023 but the present FIR was lodged after inordinate delay of 18 months for which there is no plausible explanation which itself casts serious doubt over the entire prosecution case. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the clean antecedent of the petitioner and other circumstances of the case, the prayer for grant of anticipatory bail to the petitioner is allowed. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail
Patna High Court CR. MISC. No.71401 of 2024(3) dt.16-01-2025 3/3 on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Aurangabad in connection with Tandwan P.S. Case No. 89 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
