1. Heard Mr. Sandip Kumar Gautam, learned counsel for the petitioner and Ms. Rina Sinha, learned APP for the State.
2. The petitioner seeks regular bail in connection with Barauni P. S. Case No. 15 of 2024, dated 13.01.2024, registered for the offences punishable under Sections 341, 323, 379, 307, 504, 506 and 34 of the Indian Penal Code.
3. The main submissions advanced by the petitioner's counsel are that the FIR has been registered against eleven named accused persons including the petitioner, in the entire FIR, there is no specific allegation against this petitioner, two persons are said to have sustained injuries in the occurrence, though, one injury to each injured has been opined by the

No.63655 of 2025(2) dt.17-09-2025 2/3 medical expert to be grievous but the said injuries have not been specifically attributed to the petitioner, the petitioner is said to be a member of the mob. It is further submitted that although against this petitioner there are criminal antecedents of three cases but he is on bail in all of them and in the present matter, he has been languishing in jail since 25.07.2025.
4. On the other hand, Ms. Rina Sinha, learned APP appearing for the State has vehemently opposed the bail prayer of the petitioner and submitted that two persons of the present matter sustained grievous injuries and the case is still under investigation.

Considering the aforesaid submissions advanced by the petitioner's counsel and mainly the facts that in the FIR, there is no specific allegation against this petitioner and the FIR has been registered against eleven named accused persons including the petitioner and the petitioner surrendered before the trial court in the light of the liberty granted by the co-ordinate bench of this court in Cr. Misc. No. 67688 of 2024 preferred by the petitioner for the relief of anticipatory bail, in my opinion, the petitioner is entitled to the relief of regular bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Barauni P. S. Case No. 15 of 2024 on furnishing bail bond
Patna High Court CR. MISC. No.63655 of 2025(2) dt.17-09-2025 3/3 of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, on the following conditions:
(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the trial court and shall remain physically present as directed by the trial court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
(3) One of the bailors shall be a close relative of the petitioner who has sworn affidavit in this miscellaneous petition.
