Versus

The State of Bihar .... .... Opposite Party ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH KUMAR DATTA ORAL ORDER 17-11-2016 The matter has wrongly been listed under the heading 'For Admission' and ought to have been placed under the heading 'To Be Mentioned'.

It is stated by learned counsel for the petitioners that the case of all the petitioners stood on the same footing and has been so dealt with in the order dated 15.12.2015 by which the bail has been granted to all the petitioners without any distinction but due to inadvertent error the name of petitioner No.6, Rajendra Mahton, is missing in between petitioner Nos. 5 and 7 in granting bail to the petitioners.

From the tenor of the order it is evident that there is no rejection of prayer for bail of any of the petitioners and it is a clear case of inadvertent error in typing out the name of petitioner No.6 in the last paragraph of the order dated 15.12.2015. In the aforesaid circumstances, it is directed that in the last paragraph of the order dated 15.12.2015 the name of 'petitioner No.6, Rajendra Mahton' shall also be read as the

Patna High Court Cr.Misc. No.41912 of 2015 (6) dt.17-11-2016 petitioner who has been directed to be released on anticipatory bail on furnishing bail bonds, etc. as with regard to the other petitioners, with the further modification that he must surrender within four weeks from today.

The order dated 15.12.2015 is modified to the above extent by way of correction of clerical error. (Ramesh Kumar Datta, J) spal/- U
